Washington, D.C. – Yesterday, the U.S. House of Representatives passed the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2026, which includes language from Congresswoman Beth Van Duyne’s (R-TX-24) Ensuring the Necessary Destruction of Illicit Chinese Tobacco (END) Act.

The included language authorizes the Food and Drug Administration (FDA) Secretary to destroy illegal and dangerous tobacco and vape products entering the U.S. from foreign countries.

“The inclusion of language from my END Act in the Agriculture Appropriations bill is a huge victory for public health, consumer safety, and a step in ensuring these dangerous products do not reach our shelves,” said Congresswoman Van Duyne. “This will help stop the flow of illegal vapes from places like China that have been slipping through the enforcement cracks. 

The language is included on Page 122, Line 15 of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2026

Section 801(a) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 381(a)) is amended by striking ‘‘drug or device’’ each place it appears in the seventh, eighth, ninth, and tenth sentences and inserting ‘‘drug, device, or tobacco product’’.

This change explicitly includes tobacco products and ensures they are treated the same as counterfeit drugs or medical devices when intercepted by federal authorities, this allows the FDA to destroy these dangerous products upon import, keeping them out of our communities.

The END Act was originally introduced in the House by Representative Beth Van Duyne (R-TX-24) and Representative Debbie Dingell (D-MI-6) on November 7, 2025, and introduced in the Senate by Senator John Cornyn (R-TX) and Senator Martin Heinrich (D-NM) on November 6, 2025.
